Cross-border collection project

1. Represented multiple foreign banks in filing debt assumption and denial of personality lawsuits in China. At the same time, recognized and enforced the effective judgments in Taiwan region, and adopted multiple means and multi-angle measures to successfully collect accounts receivable of up to 20 million US dollars from these foreign banks.

2. Represented a foreign-funded enterprise in a dispute over a sales contract with an overseas company. Initiated litigation procedures both domestically and overseas, preserving property domestically and evidence overseas. Eventually, successfully recovered 30 million yuan worth of goods payment.

Shareholder rights protection project

I represented a founding shareholder in competing with other founding shareholders for control of a listed company, initiating over ten series of lawsuits involving invalid resolutions, shareholders' right to know, and damage to the company's interests. These lawsuits are still ongoing.

2. I represented a certain founder in handling a case of equity repurchase put option, with the amount involved reaching as high as 28 million yuan. The High Court held that after the repurchase conditions were met, the investor should promptly urge or request a repurchase. The exercise period exceeded a reasonable period, and ultimately rejected the investor's claim.

3. Represented a minority shareholder in handling a dispute case with a certain company and a major shareholder. By combining litigation strategies with non-litigation plans, successfully obtained a large amount of equity repurchase funds for the minority shareholder and achieved the goal of withdrawing from the company.

4. Represented a state-owned enterprise in handling a dispute over a Sino-foreign cooperative operation contract with another enterprise. At the same time, initiated a lawsuit for shareholders' right to know, and through mediation, successfully secured the legitimate rights and interests of the state-owned enterprise.

The project reversed in the second instance result

I represented a state-owned enterprise in the second instance of a dispute over the damage to the creditor's interests between a shareholder of a certain company. The first instance court ruled in favor of the state-owned enterprise. In the second instance stage, we successfully achieved a phased victory by remanding the case for retrial. In the first instance remanded for retrial, we obtained a completely overturned judgment.

2. I represented a certain company in handling a second-instance case of a sales contract dispute. The first instance court determined that the company was engaged in fraud and required a refund and triple compensation. After taking over, I dissected the transaction behavior. Eventually, the second-instance court ruled that there was no fraud and obtained a complete reversal of the judgment.

3. We represented a certain logistics company in handling the second instance of a dispute over the right of subrogation in insurance. The first instance judge did not accept the defense that the cause of the accident was force majeure. After taking over the second instance, we put forward multiple appeal reasons and viewpoints based on the constituent elements of the right of subrogation. Eventually, the second instance court held that it was not mentioned in the first instance and achieved a phased victory by remanding the case for a retrial.

4. I represented a certain company in handling the second instance of a construction project contract dispute. During the second instance, it was found that the responsible party had not yet been clarified in the first instance. Eventually, we achieved a phased victory by remanding the case for a retrial.

With over six years of professional experience, I serve as a partner and a member of the Commercial Dispute Resolution committee at Shanghai Dehe Hantong Law Firm.
