1.In cases of trademark infringement, I represented the plaintiff and, in light of the defendant's intentional and persistent infringement after the termination of the contract, as well as the serious circumstances such as the large scale and long duration of the infringement, based on the licensing fee standards stipulated in the original franchise contract, constructed a clear and reasonable calculation model for the compensation base and persuaded the court to adopt four times the punitive damages.
2.The second instance court facilitated a reversal of the verdict. The compensation awarded in the first instance was too low. The court held that "the plaintiff failed to submit evidence to prove..." The "licensing fee for Registered trademarks" can only be determined comprehensively and at discretion. In the second instance, new evidence was submitted in a targeted manner, successfully reversing the basis for compensation calculation. The second instance court adopted it, changing the calculation basis from the vague "comprehensive discretion" to the clear "reference to trademark licensing fees", and ultimately increasing the compensation amount by three times.
